1. Agreement to these terms

These Terms of Service are an agreement between you and Saculsan Ventures OPC (“we”, “us”), a One Person Corporation registered in the Philippines, covering your use of the FamilyBeacon mobile application and related services. By creating an account or using FamilyBeacon, you accept these terms. If you do not accept them, please do not use the app.

Our Privacy Policy forms part of these terms.

2. Who can use FamilyBeacon

3. Circles, Owners and members

FamilyBeacon organises people into Circles. A Circle has an Owner who creates it and manages the subscription, and may have members and, on the Family Pro tier, a Co-Owner with equivalent permissions.

4. Adding a child to your Circle

When you add a child to your Circle, you represent and warrant that you are that child’s parent or legal guardian and that you have the authority to consent to the collection of their location data.

Before any location is collected from a child’s device, FamilyBeacon shows the child an age-appropriate notice explaining what is happening, and records a timestamped consent entry. You may withdraw that consent at any time by removing the child from the Circle.

You must not use FamilyBeacon to track a child you are not the parent or legal guardian of.

5. Safety features — important limitations

FamilyBeacon’s emergency features, including SOS and crash detection, are provided on a best-effort basis and are not a replacement for calling emergency services directly. Saculsan Ventures OPC and its service providers are not responsible for the outcome, timeliness, or occurrence of any emergency response, and features may fail to activate or deliver due to network conditions, device settings, location accuracy, or other factors outside our control.

In plain terms: in an emergency, call 911 first. FamilyBeacon alerts your family — it does not contact the police, fire service, or an ambulance, and it does not summon help on your behalf.

The same applies to every other alert in the app. Place arrival and departure alerts, no-show alerts, low-battery alerts, device-offline alerts, tamper alerts and location accuracy all depend on a working phone, a working network, and the device’s own location services. An alert that does not arrive is not proof that nothing happened, and a pin on the map is not proof of where someone is right now. Please do not rely on FamilyBeacon as your only means of knowing your family is safe.

7. Cancelling and downgrading

You may cancel at any time. Your paid features continue until the end of the period you have already paid for, and then your Circle moves to the Free tier.

When a Circle moves to a lower tier, features and history windows are reduced to that tier’s limits. History older than the new tier’s window stops being visible, and place alerts above the new tier’s limit stop firing. We will show you what changes before a downgrade takes effect. You can delete your account entirely from within the app, which is separate from cancelling a subscription — see our Privacy Policy for what happens to your data.

8. The referral programme

FamilyBeacon has a referral programme. It works like this, and we would rather over-explain it than have anyone misunderstand what it is.

We aim to keep FamilyBeacon running continuously, but we do not guarantee uninterrupted service. The app depends on your device, your mobile network, and third-party providers for maps, push notifications, SMS and payments, any of which can fail or change. We may modify, suspend or discontinue features, and will give reasonable notice of significant changes where we can.

11. Our intellectual property

FamilyBeacon, the FamilyBeacon and Saculsan Ventures names and logos, and the app itself are owned by Saculsan Ventures OPC. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app. They do not transfer ownership of anything.

Content you add — your profile photo, your place names — remains yours. You grant us only the permission needed to store it and show it to your own Circle.

12. Limitation of liability

To the fullest extent permitted by Philippine law, FamilyBeacon is provided “as is” without warranties of any kind. We are not liable for indirect, incidental, or consequential losses, for lost profits, or for any harm arising from a failure of a safety or alert feature, a delay in an alert, an inaccurate location, or reliance on the app instead of contacting emergency services.

Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you actually paid us in the twelve months before the claim arose.

Nothing in these terms excludes or limits any right you have under Philippine consumer protection law, including the Consumer Act of the Philippines (RA 7394), or any liability that cannot lawfully be limited.

13. Suspension and termination

You may stop using FamilyBeacon and delete your account at any time. We may suspend or terminate an account that breaches these terms — particularly section 9 — or where we are required to by law. Where it is reasonable and lawful to do so, we will tell you why.

14. Governing law

These terms are governed by the laws of the Republic of the Philippines. Any dispute will be brought before the courts of the Philippines. We would much rather resolve things by email first — please write to us before escalating.

15. Changes to these terms

We may update these terms. If a change materially affects your rights, we will notify you in the app and update the date at the top. Continuing to use FamilyBeacon after a change means you accept the updated terms.
